Abstract
This chapter looks into the concept of palingenesis turning either into the modern concept of revolution, or the more recognizable concept of the Renaissance. The Roman revival was matched by autonomy reverting to its older meaning of self-government, and civil society recovering its earlier association with the state. According to Heinrich Ahrens, Roman liberty was not modern liberty, and neo-Roman liberty would simply open a door to imperialism. The chapter provides an overview of Johann Kaspar Bluntschli and his theory of the modern state before considering the liberal foundations of Realpolitik presented by Heinrich von Treitschke. It also explains how Otto von Gierke used the concept of a Genossenschaft to try to reconcile the rival camps of Romanists and Germanists in nineteenth-century German legal and political thought.
